These Terms of Use govern your access to and use of Rally Rabbit, a paddle demo management platform. By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, do not use Rally Rabbit.
These Terms apply to all users, including club members, guests, and club administrators.
1. Description of Service
Rally Rabbit enables tennis club members and guests to browse, reserve, and return demo paddles for pickleball, padel, and tennis. The app connects users with club equipment inventories and allows club staff to manage the demo program digitally.
Rally Rabbit is provided as a software tool only. Your club is responsible for maintaining its equipment, establishing demo policies, and resolving any disputes related to physical equipment.
2. Account Registration
To use Rally Rabbit, you must create an account. You agree to:
- Provide accurate and complete registration information
- Keep your account credentials confidential
- Notify your club administrator immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
Rally Rabbit reserves the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent activity.
3. Paddle Demo Rules
When using the paddle demo service through Rally Rabbit, you agree to:
- Return paddles by the due date and time indicated in your reservation
- Use equipment in good faith and in a manner consistent with its intended sport
- Report any damage to equipment immediately to club staff
- Not transfer or lend reserved paddles to other individuals
Your club may impose additional rules, fees for late returns, or replacement charges for damaged or lost equipment. Those policies are set by your club and are separate from these Terms.
4. Acceptable Use
You agree not to use Rally Rabbit to:
- Violate any applicable laws or regulations
- Submit false or misleading information
- Attempt to access other users' accounts or data without authorization
- Reverse engineer, copy, or create derivative works from the app
- Interfere with the operation or security of the platform
We reserve the right to suspend or terminate access for any user who violates these Terms.
5. Intellectual Property
Rally Rabbit and all content, features, and functionality within it (including but not limited to the name, logo, interface design, and software) are the exclusive property of Rally Rabbit and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the app for its intended purpose.
You may not reproduce, distribute, or create derivative works from any part of Rally Rabbit without express written permission.
6. Disclaimers
Rally Rabbit is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of security vulnerabilities.
Rally Rabbit is not responsible for the condition, quality, or safety of any physical equipment made available through the platform. Your club bears full responsibility for its equipment and demo program operations.
7. Limitation of Liability
To the fullest extent permitted by law, Rally Rabbit and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app or any equipment reserved through it.
In no event shall our total liability to you exceed the amount you paid (if any) to use Rally Rabbit in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Rally Rabbit, its affiliates, and its personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or your violation of any rights of another party.
9. Modifications to the Service
We reserve the right to modify, suspend, or discontinue Rally Rabbit at any time with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.
10. Changes to These Terms
We may update these Terms from time to time. The updated version will be indicated by a revised effective date. Continued use of Rally Rabbit after the updated Terms take effect constitutes your acceptance.
11. Governing Law
These Terms are governed by the laws of the state in which your club is located, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Rally Rabbit shall be resolved in the courts of competent jurisdiction in that state.
